Mr. McMillan:

As we explained to you on a prior occasion, we reviewed your complaint and determined that our sole area of inquiry would be as to whether the Austin Police Department is maintaining the evidence gathered December 22, 2011, as required by law. Our inquiry revealed that APD continues to maintain the evidence gathered on December 22, 2011. In addition, they have noted that the Travis County District Attorney’s Office has requested the said evidence continue to be maintained. This resolves our inquiry. As we explained to you, the decision as to how to utilize investigative resources in a sexual assault allegation falls within the purview of the Austin Police Department. Therefore, we believe our involvement in this matter is concluded.
